In the latest of our Brexit Essentials series of briefings, we consider recently-published changes to the draft Withdrawal Agreement which, if agreed, would mean EU-wide rules on the recognition of jurisdiction agreements ceasing to apply to and in the UK after December 2020. The Hague Convention on Choice of Court Agreements will provide an alternative route for upholding, in the EU27, English exclusive jurisdiction agreements. Where the Convention applies, it will also ensure court judgments are enforceable across the EU27. This briefing tells corporates what they need to know about the Hague Convention.
