Efstathios has a broad-ranging international commercial litigation and arbitration practice with particular experience of London market and international insurance and reinsurance disputes. He has acted on a wide range of cases for policyholders, insurers and brokers, including in relation to policy coverage and interpretation, non-disclosure and misrepresentation, and brokers’ liability issues. Other areas of expertise include corporate restructuring and insolvency matters, and technology and outsourcing disputes.
Highlights include advising:
- Liverpool Football Club (LFC) in relation to a series of high-profile injunction applications in the English and Dallas courts which threatened LFC’s sale to New England Sports Ventures (NESV)
- Equitas in relation a claim against Walsham Brothers (Walshams) relating to amounts that Equitas believes Walshams has collected on its behalf but not paid to it, in some cases for periods in excess of 20 years, together with investment returns on those sums worth in excess of US$20 million. The Commercial Court held that Walshams did have a continuing duty to Equitas to remit funds due to it (such that Equitas' claims to those funds were not time barred), that Equitas is entitled to recover its lost investment returns on those amounts and that Walshams was not entitled to set off amounts it alleged was due to it against those sums. Stage 2 of the trial will consider quantum
- a global investment management firm in relation to various complex economic tort claims, including procuring breach of contract, conspiracy and causing loss by unlawful means
