The feature article reports on the Competition Appeal Tribunal (CAT) quashing, on grounds of apparent bias, the findings of the Competition Commission (CC) into BAA Limited’s ownership of UK airports.

The CAT has referred the matter back to the CC for reconsideration and has refused the CC’s application for permission to appeal, due to the fact that it did not believe that the CC had a real prospect of success. The CC has until the 12 March 2010 to decide whether to seek leave to appeal from the Court of Appeal.
