The EU Competition Rules on Intellectual Property Licensing

This publication is a guide to the European Commission’s Technology Transfer Block Exemption Regulation (TTBER). It also provides guidance on Article 102 (abuse of a dominant position) issues and compulsory licensing.

With regard to the TTBER and the accompanying guidelines, the publication focuses on the safe harbour of the block exemption and the 3 step test, the withdrawal and disapplication of the block exemption and the assessment outside the block exemption.
