The EU competition rules on cartels

This publication provides an overview of the competition rules applicable to cartels within the EU. It explains the relevant legislation and who enforces it. It also describes the typical steps involved in an investigation and the investigative powers available to the enforcement authorities. It then considers the applicable sanctions, the leniency options available to companies, the potential for early settlement of cases, and the judicial review process. A comparison of the EU and UK rules applicable to cartels is also provided.

This publication also aims to assist companies in managing cartel investigations. It provides guidelines on how to develop a focused strategy for handling cartel investigations (including some basic information on how to establish an effective antitrust compliance policy). It also provides an overview of the key dos and don’ts for handling a surprise inspection by the competition regulators.
