British Airways - Application to High Court

Slaughter and May advised British Airways (BA) in its successful application to the High Court to stay complex Part 20 contribution proceedings against over 30 airlines worldwide. The hearing before Master Moncaster involved an unusually large number of parties from various jurisdictions, with Emirates (represented by Freshfields) seeking discontinuance of the proceedings. The contribution proceedings brought by BA were in response to the so far unsuccessful attempt by Hausfeld, the global class action firm, acting for two flower importers, to import US-style class action litigation into the UK. This attempted follow-on class action arises out of a European Commission investigation into alleged cartel activity involving a number of airlines and cargo operators worldwide active in the provision of air freight services.
